Let's poke a hole in that theory.
So it's encrypted. How does that stop the RIAA from just downloading with encryption that music file then using the DMCA to get you info so they can sue you?

If you advertise songs as available from your share directory then encrypting that information would grind P2P to halt as no one would be able to share. You could just trade public keys with another user but then how does this make it any differnt than sharing over a secure messaging client?

Encryption won't help at all.

Just like DRM won't stop fileswapping encyption won't hide you're identity.
