He still doesn't quite get the fact that opt-in *IS* an automatic "do not solicit". No opt-ing, no soliciting of any sort happens. (e.g. an e-mail sent completely out of the blue saying "would you like to join this list" is *NOT* opt-in)

The sole criteria of whether or not something is spam is whether you granted consent for it. Nothing more, nothing less. If consent was revoked and they keep sending, it's spam. If you never gave consent, it's spam. In most circles, this is what is meant by "opt-in" - verified, revokable, fully informed consent is given to that sender.
