You say: The foreign workers are happy with lower pay and worse working conditions than an US worker.

..that's exactly what I argued against in the article. Foreign workers are NOT satisfied with poor working conditions and low pay. They can live like kings in their home country, because they are the best and the brightest in their home country.

As companies seeking only foreign workers, I can't speak to your experience. Do companies seek H-1B candidates? H-1B is FAR more complicated a process than just hiring a domestic worker, just as hiring a local swiss person is FAR easier than hiring me. Like I noted, the H-1B income average is pretty close to the norm among American workers, so if they choose an H-1B worker, they take on the work permit hassle PLUS they need to deal with the cultural dislocation which is sure to exist.

Doesn't mean that someone somewhere operates under the notion that they can force foreign workers to work stupid hours. Just remember, though, that H-1B workers are not strawberry pickers, and aren't likely to put up with what some think they are willing to put up with.
