What is free software websites have a rider you have to accept saying "This software is illegal to use anywhere in the EU"?

Then use an out-of-EU website to dispence the software.

Surely there can be no comeback if someone within the EU "illegally" downloads it and uses it? It is not a "legallay enforceable" illegality, but a self-imposed one by the software issuer. It can be ignored. Would the EU have any comeback?
