The Supreme Court doesn't decide the wisdom of the consitution - they determine the SPIRIT of the law from the LETTER of the law. Sometimes it looks like the LETTER of the law is being changed, but the Supremes can interpret as they wish.

It looks like that Constitutional Amendment was written because of Papa Kennedy! North Carolina, for instance, can ban alchohol sales in many counties - because of this law.

There may be some "wiggle room" as this passage might be interpreted as applying to mass distributors as opposed to single-party transactions, but it will be a tough sell to the courts.

What the states SHOULD do is provide a state website that would allow anyone to order any alcohol they wished - and charge them a duty right there and then. Each alcohol distributor would be welcome to register with the state to use this service.
