I think what he's getting at
is that as long as you don't hold the double standard (i.e. it's okay for Apple to do this sort of thing but not MS) then fine, but just don't call MS on the carpet for doing something similar.

Personally I think Apple does have a legal right (actually that's indisputable) but that does not mean it should exercise that right. If *only* Apple products have this feature, then either no one else will have anything like it, or they will find a way to work around the patent while still accomplishing the same thing. Either of which would make multi-touch non-intuitive to non-Apple users, which of course would drive away new sales.

I know for a fact that many people (I know some) who have eschewed Apple in the past because when they tried a floor model of an Apple with a one button mouse, they could never figure out how to make a menu stay open so they could click the option they wanted. They didn't know you had to hold the button down to keep the dropdown open and let go when you reached your selection. If Apple has an interface they can't get used to because it's not like the other devices they've used, even if it IS better, Apple will not win these people over. If but if other devices could license the technology at a reasonable rate, when Apple gets its gains from the patent, and the tech also becomes the norm.
