Carl, I do agree with the COA in part.
If you are tied to Judge Jackson's very, very narrowly defined universe of computing then he had a point.

However, to agree with it one must agree the ONLY PC's in the world are built on the X86 CPU. Apple and IBM obviously would have a very different view but of course Jackson didn't want to hear them. Palm too would have a different view but they too were not allowed to speak. And you know those transmetta guys, well they had nothing of value to offer either.

You also have to toss out PC's that are used in the role of a server. Why? Because it would have shown it to be a false argument of course. What about Sun and their diskless workstations? Well, they don't count either. IBM? Naw, they aren't competition...

The thing is, I could take ANY market and narrow it down to a fine enough point to "prove" that someone holds a monopoly in it. (GM holds a true monopoly in the Chevy small block 350 engine.) But that doesn't prove a true monopoly at all, if anything it shows that said company has done an excellent job of finding their niche and satisfying the consumers in it.

For this reason, I do not agree with the monopoly ruling.
