I'm looking at the delicate problem of when Courts should impose a definite harm to prevent a projected future outcome when the entity being harmed (Microsoft in this case) has not finally been proven in the wrong, and will not be for years to come.

That's really far too complex an issue to fit with your emotions. At least today. Maybe tomorrow will be better for you.
