Okay.

Now imagine Monti overstepped his bounds, that either his determinations are wrong or his remedies are excessive. Both are issues.

Microsoft will be damaged by these penalties. The no-integrated-media-player penalty will cost time and energy even if no one buys the Monti operating system. The surrender-server-IP penalty is intended to let competitors match any competitive advantage Microsoft has, and is supposed to keep on hobbling Microsoft's ability to compete until Monti's successor says it can stop.

So, are you so insistent on harming Microsoft that you'd do damage even if there were no legal reason?

Essentially, the Chief Judge of the Court of First Instance is pre-trying the case. His finding may be the most important of all the decisions made.
Because of what's at risk, I can see why Microsoft is hoping to talk with a rational successor to Monti, assuming the successor is more rational than her predecessor.
