The look of scrabble is more valuable than the actual play of the game from a marketing standpoint

Crossword puzzles can be copyrighted, but you can't protect the concept of them, you can only copyright a single puzzle at a time, unless they are part of a 'theme'

Many chess games are copyrighted/trademarked, but that applies to the peices themselves and or the design of the board. NOT the game.

so literati, while it plays the same as scrabble, doesn't look like scrabble, therefore it misses out on the lawsuit.

My personal feeling is that they are getting too all inclusive with the patent and copyright laws (what was that tree that was copyrighted?) They're no longer using any common sense with them.
