Ok, kind of. From a legal perspective, whether or not an email is solicited makes all the difference as to whether or not it's spam.

But most people don't care whether or not they asked for or agreed to something. They care about whether or not they want to read it. So if I want to develop/market anti-spam software, I want to develop.market a product that filters out email that people don't want, not email that they didn't solicit.
