For example lets say I've been getting email for used cars but I'm not buying a car so it's SPAM but then when I'm in the market for a car that email may no longer be SPAM.

Not if you didn't ask for them for email about buying a car.

Say a Spammer sends me email out about a great deal at KFC. I'm hungry right now, but that doesn't magically make the KFC Spam "not Spam". I didn't ask for it to be sent to me, so it's Spam.

If you didn't ask for it, it's Spam. Period.
