Joking aside, you do have a point
There are way too many of these blanket laws here in CA. They've got good intentions, even though they often miss the mark (as I believe this one does).

We've already got a law which covers this in a better way anyways. There's a law against driving recklessly, which could be applied to those who shouldn't be driving with a cell phone in hand, talking to a passenger and ignoring the road (my mom has a big problem with that), trying to eat lunch while driving with one's knees, and so on. Some people can drive and talk on a phone just fine, while others just can't.
