Just as Copyright law was used to fashion the GPL, patent law can cut those that seek to use it against Linux. DRM can also be used in the same way.
Even though we disagree with some of these things, rather than to roll over in a ditch, I think that the Open Source Community is very capable of using these legal tools, and ultimately if forced to, would give even the biggest of big boys a roasting they'd scarcely survive.
