Read the terms of your EULA and the Microsoft Enterprise/License6 agreements.

Microsoft's EULA only offers you very limited conditional cover to the price of the software package.

Microsoft's License6 agreement does not cover you for any code you write or is from a third party, even if the infringing IP is included in Microsoft's APIs.

Cognos found this out with Microsoft's SQL server at cost to Cognos totaling $1.75 million
