Patent system SHOULD be falling
This particular discussion about patent problems for Linux is only a subset of the overall software patent debacle.

Any successful piece of software will get sued for something.
Processes have been patented.
Basic functionality from tabs (thanks Nigel) to ecommerce itself is patented by somebody.
It's absolutely ridiculous.

The MAD insurance policy only helps those big players that have a stockpile.
Linux and independents are ultimately doomed unless something is done.

It's appears impossible for the PO's to distinguish good from nicely worded frauds.
Combine that with the current stockpile that cannot be simply invalidated en mass, the application and challenging process has to be as public, transparent and easy as possible.
There must also be a major review of applicability to software and therefore of the existing stockpile.

We as a community can also help by demanding our leaders pull the finger out.

If the Eolas patent is upheld it will possibly be the first to affect the public at large.
That's when it needs to be brought to a head.
