This is why
you have Copyright on books, art, music, software etc and NOT patents in any sane juridiction. With Copyright no one can steal your work (writing the program) but anyone can (with lots of work) make a competitive software, without needing to read lots of patents and make a creative interpretation of it's contents.

Patents should be something in the physical world that solves a problem for the industies. Software and buissiness plans are not phisical sollutions on a physical problem.

And how bad isn't it that a software can be protected by both Copright and Patents, by different people...

(Though as some one wrote, software can be a part of a solution, and in that way patetable)
