In which case modify the law to a use it or lose it

Laws can be changed by Congress after suitable democratic pressure.
If the people do not want a "use it or lose it" type of patent law, then change it.
If the really big players resist the change, then it is clear that they like the rules as they are, and that all that is happening is that M$ is having a whinge and is fundamentally a sore loser
