There is a visceral hatred of all things MIcrosoft which seeps through to the public, to Europe, and to juries -- and shows itself frequently in posts right here. Odd, I think, that while Microsoft is held to be in violation of everyone else's intellectual property, it is not allowed to have any of its own -- and must open up its own developed systems to everyone else "just because." With the incentives provided by the current Patent Laws, lawsuits will surely continue -- but at some point the Patent system will be modified, and there might be a return to some rational damages when there is, in fact, a theft of a patented process. As it stands, when corporations are permitted to patent anything and everything, to establish a basis for suit (since they don't go on to produce anything based on that patent) they get to simply wait for someone, anyone, to go forward to develop something from what may well be an idea - and not one which is all that hard to come up with. It is the execution (not the ideating, as noted in IBM's clever ads) where the hard work is -- and Alcatel is happy to gain millions from Microsoft's work.
