We have reached a point where the volume of Intellectual Property has reached critical mass. We appear to have reached a point where only a super computer can scan for code that is under patent. Avoidance of overlapping code is a monumental task. I suppose that, with the huge number of dollars involved with computer software, that these litigations are inevitable. Perhaps with the continued growth of Free and Open Source software, this will all abate somewhat.
