That is why you have a patient, to protect your idea and to have the opportunity to make money on it.
But, having seen patient fights and how they run it could well be that the case wouldnt be taken on by anyone until there was an opportunity to make money from it by the attorney. Not having the money up front means you need to have it done on contingency.
That said, the system needs a major overhaul.
