There May Be Another Reason
...why Gibson is doing this. One has to assume that they wanted to sell something that uses their patent some day. If they don't try to defend their patent now, they will have given up the right to defend against a direct violation. That's how Bayer lost the rights to the Aspirin name.

Some companies choose not to patent things and just be very nimble about constantly innovating, just to avoid all the legal expense and distraction of management resources.
