Not the point...
I'm also a "real guitarist" but I also happen to love playing the Guitar Hero series, simply because I enjoy music games. I'm also an electronic composer and that didn't stop me from playing Amplitude or Frequency when Harmonix published those so many years ago, for the precise reason you just stated: it's a video game, it isn't real life. So while you think it's "amusing" that someone would rather play Guitar Hero than buy a cheapo Epiphone and learn to play guitar in real life, I think you should step back and realize that there are probably just a lot of people out there who don't find playing a guitar to be very fun, but they do find playing music games fun.

As far as the patent argument goes though, you have to understand how intellectual property works: in 1998 Gibson was awarded the rights to their patent which involves a similar invention/innovation to the one at the core of the Guitar Hero series. It costs a good chunk of change and takes a fair amount of work to get something like this patented, and it only seems fair that Activision (or in this case, Harmonix's liability which Activision bought when they purchased the rights to GH) play by the rules, if that's what the courts determine. I wouldn't be surprised if the court rules in Gibson's favor either, the more I read this patent the more I think they've got a case.
