I do like software patents if....
If they adhere to the principles of invention, that they are uniquely created tools to complete a desired end or result.

If some individual creates a certain tool such as a car part that allows increased functionality, he should have the right to patent it. If someone creates code that allows a unique and necessary result for something, it is the same. How many software patents does Microsoft have?

I work for the govt., and often write software. We patented 2 of the codes I wrote as they embodied processes and data compiled over decades at great expense. If we could not protect these codes with patents, then some other organization would take our methods and the govt would have to pay for what they invented already! This has happened in my line of work, I have seen at least 4 cases of it- and it costs the taxpayers money. It was extra work on my part to process the patent paperwork. Most would not want the bother. But diligence in cases like this saves the taxpayers.
