Out to lunch
Not to defend MS here, but you do not have any clue about why and how these cases come to light. First off, many many many small time programmers and code writers are unknowingly, and unknown in the public to have broken software patent protections over and over again.

That happens, first of all because the programs they have cooked up are used by themselves and a select few, and second, all they did was write up some obvious code to solve a problem that any decent coder would come up with given the need.

They don't really know they are breaking patent laws and neither does anyone else of importance if they are that low profile.

On the other hand, a massive software company like MS which is continuously producing billions of lines of code for their programs which are super high profile will continuously be caught breaking patent laws because the vast majority of those patents are protecting software that any good program writer would come up with given the need; and by the way. those kind of things are not inventions if they can be conjured up by most people trained in the art, because thats not an invention, thats just winning the first place race to the patent office.
