Neither is fair. Sheer lunacy to the whole mess
Your little lecture on patents skirted the critical issue that makes the whole thing a mess. Patents are given for inventions; true "inventions" are not just useful, they are unique in that they are brought into existence by a mind that didn't simply create what would be obvious to someone who was trained in the art. Much of the individual components of software are the result of just that; the simplest code required to get the job done right.

Admittedly, a real software inventor of true inventor status will be able to come up with such code where nobody else can, thats an invention. Just being the first to write some specialized code, in many cases, code that nobody else is interested in at the moment, is not an invention of any true kind if its just code that most trained people in the art would eventually write if they had a reason to put their mind to the task. Thats not an invention, and that is not supposed to be protected by patent law.
