I think what he means is that with the DMCA, you can't bypass any protection shcemes they have in place for the program. This means that, as long as they have something in place, you can't legally apply any patches to the program that would stop it. On the other hand, like you said, there isn't anything to prevent you from just blocking the connection external to the program.

I'll also throw out there that EULA's are mostly meaningless anyways.
