It's wrong because...
it attempts to define "spyware" in a focus that is too narrow and leaves horrendous malware like the CoolWebSearch trojan varients unaffected by the legislation. Instead of focusing on the definition of spyware, the bill should instead focus on the behavior that needs to be banned.

This is another example of poor legislation along the lines of the CAN-SPAM bill. Poor legislation sometimes is worse than none at all, as is the case here.
