Lawyers are irrelevant
If you bought a PC from a reputable vendor, they would have only offered Home Basic for those machines that were only capable of running home basic and offered home premium, business and/or ultimate to the rest.

If these people got shafted by the upgrade process, then they should sue the OEM, not MS. If the OEM feels that MS misled them, then they should sue MS.
