You did not mention the fact that the big 3 software developers (IBM, Microsoft, and Sun Microsystems) have used their software patents to basically grind software innovation to a nearly complete halt. Or that the oil and transportation industries have used the patent system mostly for the purpose of making sure that earth saving inventions will never see the light of day (actual production). The patent reforms you mentioned don't go anywhere near far enough. A patent should not be sustainable without an item that makes use of that patent going into production within a reasonable time frame (7 years). And all software patents by nature inhibit the progress of computer technology too much to continue allowing them to exist AT ALL.
