Prior art often exists which could make patent applications fraud
There is also the real issue of large software companies filing patent applications when in fact the "invention" is already in public domain so prior art exists. It is apparently fraud against the state to knowingly do so but have the authorities ever held these large companies to account? These companies rely on the over worked Patent Office to find prior art and thus patents slip through by default....put more responsibility on the applicant - a couple of high profile prosecutions will help sort this one out!
