re "House OKs revamp of patent system"
NOTE: I haven't read the bill itself yet.

First of all, I would like to see a bit more detail on what's being debated. Not too much information to make a good judgment right now.

"and is not in line, procedurally, with foreign systems."

Yeah, and lots of the foreign systems are broke even worse then our system. I want to fix our system, not bring it in line with other systems. I definitely do not want to copy something that might be broken even worse.

"A windshield wiper found to an infringe a patent should not spur a damage award based on the value of the entire car."

I'd have to agree with Google here.

"A "first to file" patent system: Critics argue that the existing "first to invent" standard is problematic because the identity of an inventor can be hard to prove."

Which is nice - except it's treating a head wound by putting a leg in a cast. Let's fix what's really broken first.

"A new way to challenge patents out of court"

A good first step - but too small I fear. Sure, streamlining the process is nice - unfortunately it only deals with the symptoms, not the root cause.

"Limits on findings of "willful" infringement"

Again, just treating the symptoms rather than the root cause.

"Limits on courts where patent cases could be filed"

At risk of sounding like a broken record . . .
again, just treating the symptoms rather than the root cause.

"A ban on "tax planning" patents"

Which I'm sure will be nice for the tax season - but won't help at all for any other purpose.

In conclusion - this really won't do too much. It's a nice attempt to mitigate some issues and make things a bit easier, but it really doesn't address the core issues.
