Good ideas Bit...

You have a few good ideas there Bit.

I like #5. A use it or lose it clause. Either implement it within a prescribed time or sell it to someone who will or lose it. This will definitely make life hard for the patent trolls who produce nothing.

I see your intentions with #1 but I think it would have the opposite effect of what you would be trying to achieve. With an escalating cost for additional patents only the big players would be able to afford multiple patents making it rough on the little guys/gals.

As to #4, I don't know about annual renewal but given the accelerating pace of innovation over time I would think that patents should be for a shorter term.

#3, I think requiring due diligence is a great idea. If a patent holder has been aware of infringement for a number of months they should be required to make their claim and say, if the alleged infringement has continued for over a year without a claim by the patent holder they lose the right to make a claim. #6 is also a good idea. The litigation process takes so long it's almost useless.

Software should not be patentable. Copyright is appropriate for software.
