Patents != Capitalism
Lets remember what patents are.
They are state enforced grants of artificial exclusivity for a short time to serve as an incentive for innovation. They were not originally intented to be the basis of long-term business models which tends to stifle innovation.

The first to file policy forwarded by these 'reforms' would make the patent system more anti-competitive.

If the corporate agents known as 'congresspersons' were really interested in reform and serving the best interests of the People they should do a number of things. Retain the first to invent model. Abolish software patentability.(copyright is appropriate here) Shorten the term of patents. Prohibit injunctions relying on cease and desist orders only after infringement is proven and limit damages.(this attempts to thwart IP holding companies from using legal extrotion as a business model)

Also, the barrier to entry must be lowered to individuals. Pursuing patents is cost prohibitive to individuals and small companies. This provides large corporations with a serious anti-competitive advantage.

Lastly, the issues of prior art and obviousness should be far more vigorously investigated by the Patent Office by people who actually understand the related technology prior to issuing patents.
