Like I said, you have the right to privacy. Period.

Litigation doesn't give you new rights ... you already have them. The point I was trying to make is that litigation only describes how the rights you have are applied to a specific situation.

And the only way to lose a right is to (1) give it up, (2) the state suspends that right through the due process of law, or (3) politicians slowly pass litigation that chip away at it.

Yes, there are some times (when you go outside as you mention) that you willingly give up a certain amount of privacy. But that doesn't mean that you don't have a basic right to privacy. Or that give are willingly giving up all rights to other types of privacy.

Keep in mind that we are not talking about going outside. We are talking about online privacy in which a person might not understand what rights they are giving up -- or may be tricked into giving up rights that they shouldn't.

The Constitution was drafted in plain language, and was meant to define the MINIMUM rights, priviledges and freedoms that will be recognized by the government.

To many people have forgotten that, and see legislation as being the upper limit of what you are allowed to achieve under law.

It's sad really, when you think about the sacrifices that have been made, and the ease with which people are willing to give it up.
