I think this is a real slipery slope. If google is being sued for providing a service that happens to be taken advantage of and they are responding to all take down requests.
If they win where is it going to end. Are they gonna sue webhosting companies for hosting forums that happen to discuss piracy.
Will they sue myspace for discussion of piracy.
Will they sue shoutcast.
This basically leaves free game for any company that provides hosting services.
They cant sue companies for unknowingly hosting pirated stuff even after a prompt response.
