Statute of Anne that created copy write and patent law did so to protect not the creator or the owner but the public?s vested interest in the right to know. Knowledge, culture, ideas, dreams, thoughts are not something that in a free society, where the idea that all people are equal, should be allowed to belong to an individual or group of individuals forever. If this idea, that ownership excludes the right of the community, to access its collective history, then individual?s basic right to liberty, free will and the pursuit of happiness will have been stolen by those, who by Machiavellian design or accident find themselves in control of the destiny of all humanity. 14 years plus the life of the creators (creator being a human being thus creators being a group of human beings) is fair and should stand as is without further interpretation by those less understanding to human rights and freedoms and more inclined to fascist communist totalitarian theocracies ideology than to democratic idea.
Now if you wish to argue, as the American courts do, that ideas thoughts, dreams can be owned like water, air and music, then start buying Chinese Tech Stock for if ideas, dreams, thoughts, freedoms, can be owned then why would the companies that produce the equipment that captures these community assets ever give up ownership. I mean if you can control history then why not leverage that to control the future? If I make the tools that allow you to make your music then why should I not own the music as you are using my tools to create? I might pay you but if I do it will be on my terms, as you are nothing without the tools that I own. Thus I can ensure that only the ideas and thoughts that I agree with will ever see the light of day. Thus ensuring that I control the message, the messenger plus the future which means I know own the past. Human History belongs to us all as with everything that you see according to human?s second science everything that you see was a gift given to all life equally.
You know MacDonald?s did not become successful because they had a patent or copy write law to stop other business from making hamburgers. MacDonald?s became successful because they allowed competition to take place and simple made a better hamburger then everyone else. but then again if you disagree with me you can always go to Wendy's or Burger King or make your own. Freedom of choice, competition, thought, culture, dreams of knowledge itself is what has allowed the West to develop. Take that away then solutions to Cancer stop being developed, new music stops being produced and written, new art stops being produced, ideas stagnates and the world comes to a grinding halt as stasis begins to set in.
I for one do not want to see a world where I am not allowed to teach my dog to dance Jazz just because someone before me bought the idea and claims exclusive rights to it forever. It is absurd to even put forward an idea that someone can own the color blue forever.
America needs to learn to compete on its quality of work, its craftsmanship in turning its community?s ideas into products and services that simple compete on their merit not on the kind of lawyer they can buy.
