Ah but they are.
The problem with juries awarding damages is the mentality that its not their money and "someone needs to pay".
I've been on 2 juries with one of them being a civil case of age discrimination. Even though the plaintiff had failed to make its case some on the jury tried to give her an monetary award because they felt sorry for her! As sad as the plaintiff's case was there was no discrimination and the defendant was not liable.
This leads to people sueing for being stupid ie scalding themselves in a shower.
Sad to say I don't see any easy answer.
