the only winners are the patent lawyers...
That's the way the system works.

First you get a patent lawyer to write you an application that claims everything, then you pay the lawyer to defend it while the Patent Office tries to whittle it down, then you pay the same lawyer to litigate collisions and infringements on the overly broad claim.

I can't imagine who would invent or support such a system!
