I think you're missing the point
The point made doesn't seem to be one of ownership of the spectrum, but the damage that could be caused by the owners of a spectrum in an unregulated environment. i.e., a neighbor or broadcaster who endangers your health with powerful high freq radio waves; or infringes on your reception of radio waves you wish to pick up.

Land owners own the mineral rights to the land, but not the air above because of the special needs--communications and flight among them. If the air goes to the highest bidder, then the land owner ought to be given grandfather rights to the air above their land, and be able to profit from it by renting or selling those rights. Now that's a free market.
