You're still missing the point
You still think of property as a physical asset. If you OWN a certain spectrum, and someone is broadcasting on it, you are infringed. Their physical location does not matter in the least.

In BOTH cases (land and spectrum) verifiable infringement happens. You don't need a special agency to police infringement in either case.

The FCC has places a limit on Ham radio operators to prevent just such abuses (the most common legal example).

And turning spectrum into private (and tradeable) property would have the same effect. Just as you could evict squatters, you could shut down those who broadcast on your spectrum illegally, whether they do it from their own land or from outer space.

Without the FCC anyone could set up a commercial multimillion watt transmitter on the cheapest location they could find, maximize their profits without due regard to your/our safety.

If you owned spectrum, then you could go to the police and say "see, they are broadcasting on my wavelength," and the police would shut them down. It would be then up to the infringer to prove their case in court.
