What he's suggesting is a stockpile of legal nuclear weapons and it's not a bad idea. Frequently companies that pull the IP litigation trick are in a position where they'll likely go out of business anyway. They're not afraid of losing because they'll be out of business either way.

Collective action has proven to be effective against abusive patent litigation. This is merely the next step in that evolution. Organized collective defense.
