Problem Is...
In most other copyright law, it isn't the responsibility of the copyright holder, it is the responsibility of the user to know if he or she is infringing on someone's work.

Sure, the copyright holder must track down the infringer, but it's the infringer's responsibility to know in advance if they are breaking the law or not.
