Have to side with them on this no_ax, its the copyright holders..
responsibility to track down infringing material on a site like this. If they point it out to google and google hands them tools to remove content that was copyrighted, then the responsibility falls back on the copyright holder.

I am not sure if they fall under the ISP definition in the DMCA, which i believe is a sticking point, but they do provide many different services for online customers. Being that youtube is not their primary purpose, that might qualify them as a service provider.

The fact that they limited the clips to 10 minutes and provide tools to the copyright holders says they are doing something and the due dilligience falls again, back to the copyright holder. You cannot force another company to decide what is copyrighted and what is not.

I hate to side with a "mega giant"( course in this case, they are on both sides), but google does have a point.
