*IF* Vonage can get the lower court
to agree and set a new trial, its a an entirely new ballgame.

But far more reaching are the implications of this decision. How effectively this new decision can be applied will now be the big challenge.

Consider this, is there really anything in software that doesn't build on the common base of common knowledge?

Manifest Destiny

Basically it means that all things happen in their time and place. Surely someone at some point would "discover" North America, someone would claim the first powered flight, Someone would harness electricity, etc., etc.

Consider the Word Processor. Surely that was worthy of patent? But under this decision is it really? I lived through the mechanical typewriter, then moved to the IBM electric and then the Selectric and then a Word processor.

One could say that the electric typewriter would be an obvious application of electricity to a mechanical device, and the the improvments to that were also obvious, and then a small amount of memory to hold a line or two of text, and then auto correct, and then it surely is obvious we don't need all these paper generators when we can centrilize it in a printer and...

The other huge thing I see as a problem is that" everything looks obvious in hindsight". I mean everyone here must know at least a dozen Monday morning quaterbacks that see everything prefectly in hindsight. Its basic human nature.

What I see here is job security for the courts for many many years to come.
