Just going by the info in the article:
If I have a patent on "insert tab A into slot B" then you cannot insert tab A into slot B in your products in the US without a license from me.

Nor can you box up all your tab As and slot Bs and send them to an assembly plant overseas to do the insertion. You'd still need a license from me.

But you can take a picture of tab A and slot B, send it to an overseas fabricatrion plant and instruct it to fabricate them and dend it on to the assembly plant for insertion. That's not a patent infringement and you don't need a license from me.

Microsoft is arguing the second scenario applies and ATT is arguing the first does.

I don't know which is right, and it seems like a silly argument if one has accepted the notion that an idea is property.

Just another example of ideas are not property, if anyone needed another.
