If they don't have to rule on patentability of software...
...they won't. The US Supreme Court has long tried to rule on only that which is needed to settle the case.

Turns out that neither litigant in this case wants software patents overturned, so I'm quite sure that the lawyers (particularly MS', since they're the defendant) have been very careful not to do anything that would call them into question.

That said, software patents stand on very shaky legal ground and need to be challenged (the Supremes have never ruled on their validity), but it's not going to happen with this case.
