How would any decision on the issues involve anything other than an implicit endorsement of software patents?

Microsoft didn't raise the issue of software patentability at the trial or appellate level, so they're not allowed to bring it up at the Supreme Court. (This is the same issue that kept the Court from ruling on patenability of thought in LabCorp.)

Since the Court is (arguably) not in a position to rule on whether software is patentable, any ruling supporting AT&T will also not settle that issue. For this case, it's assumed that it is.
