You misunderstand the law. This does not require them to save your entire emails. It only requires that records they have (user data, record of emails sent, IP address, whatever else) are saved for a period of time.

Deleting your emails from the server when you download them to your email client (Outlook, Thunderbird, Eudora, whatever) is a choice you make in the software for each account. You can keep a copy on the server even when you delete the email in your client, OR you can keep a copy on the server for a limited amount of time (for example, 7 days), OR you can have the copy on the server saved indefinitely except to be deleted automatically when you delete it from your client...meaning what's on the server mirrors what's on your computer (except the server would have emails you haven't downloaded yet).

This would mean that if, for example, the FBI intercepted an email, or found out about an email, it would be able to prove through the ISP's records that you sent the email that matched the headers...though whether the original, entire email is still available is an independent issue.
