The author seems confused.
This article suggests that the main problem was that Sony's DRM program only allowed other programs to hide undetected and wasn't so bad of itself.

The fact is that the Sony's DRM program WAS the rootkit. It made itself inextricable to the OS and it slyly intercepted system calls so that it could never be detected. Using software in this manner is insidious and Sony is getting off way too easy.
